Wu believed that the company had illegally terminated the labor contract and demanded payment of double salary at the end of the year and compensation for termination of the contract. The court of first instance held that the evidence submitted by Wu was insufficient to prove the claim of double salary at the end of the year. New Oriental Xuncheng did not provide evidence on the changes in production and operation conditions, and Wu’s adjustment from “senior development engineer” to “technical support engineer” would have impact on their career development. New Oriental Xuncheng’s transfer to Wu is unreasonable, and Wu has the right to refuse. The court of first instance ruled that New Oriental Xuncheng Company should pay Wu Mou 418,000 yuan in compensation for illegally rescinding the labor contract.

New Oriental Xuncheng Company appealed for revision of the verdict. The court of second instance believed that its appeal lacked factual and legal basis, and ruled to reject the appeal and uphold the original verdict.

It is worth mentioning that recently, New Oriental Xuncheng Company was sentenced to pay 382,500 yuan in compensation for dismissing the employee Ge who refused to transfer.
