The EU proposed the AI Liability Directive to reduce the burden of proof in prosecuting AI products. Self-driving cars, voice assistants and search engines are all likely to fall under the directive’s jurisdiction. If passed, the directive would go hand in hand with the proposed AI law – the first to set limits on AI systems. The AI Liability Directive introduces a “presumption of causality,” whereby victims will not need to decipher complex AI systems to prove a case is connected, as long as it is proven that there is a causal relationship between the product’s AI performance and the associated harm. For example, if a drone caused an injury and its AI system played a role, the manufacturer would not be exempt.
