“Ali Female Employee Violation Case” Sentence of First Instance

On June 22, 2022, the People’s Court of Huaiyin District, Jinan City publicly pronounced the first-instance judgment on the defendant Zhang Guo’s forced indecency case, and sentenced the defendant Zhang Guo to one year and six months in prison for the crime of forced indecency.

After trial, the court found out that on the evening of July 27, 2021, Zhang Guo met the victim Zhou for the first time while participating in the banquet. At about 7 o’clock the next day, Zhang Guo went to Zhou’s hotel room and committed indecent acts to Zhou again.

The court held that the defendant Zhang Guo violated the will of the woman and molested the victim while he was drunk, and his actions constituted the crime of compulsory molestation. The fact that the public prosecution agency accused Zhang Guo of committing the crime of forced indecency is clear, the evidence is reliable and sufficient, and the accusation is convicted. Zhang Guo showed no confession or repentance, and should be punished according to law. Accordingly, the court made the above judgment.

Case review:

On the evening of August 7, 2021, Alibaba certified employees said anonymously that they were asked by the male leader (Wang Chengwen) to accompany the merchant (Zhang Guo) to drink, and that he was molested after being drunk. Then, the leader opened a room for the female employee, she entered and exited the room 4 times, and raped her. The female employees gave HR and other feedback to no avail, and went to the cafeteria to distribute leaflets to defend their rights.

On August 7, 2021, Alibaba responded that it will not tolerate it and fully cooperate with the police. The suspected employee has been suspended for investigation by the police. On August 8, Jinan Hualian Supermarket responded to this, and the employees involved were suspended for investigation. On August 8, Jinan Public Security notified the incident of “Ali female employee was violated”: investigation and evidence collection are underway. On August 8, Alibaba employees issued an initiative to prepare for the establishment of a protection mechanism. In the early morning of August 9, Alibaba announced the handling decision, the business president and HRG resigned, and the suspected male employee Wang Chengwen was dismissed and never hired. On August 9, Jinan Hualian Supermarket responded to the violation of Ali’s female employee: Zhang Guo, the employee involved, was fired. On August 10, “A female employee of Ali claimed to be violated”, the clerk of the hotel “Fisher’s Lights Jinan Huanyu Store” said: The police have investigated and collected evidence, and there is no surveillance in the box.

On August 14, 2021, the Jinan Public Security Bureau Huaiyin District Bureau issued a situation report saying that according to Article 237 of the Criminal Law of the People’s Republic of China, criminal suspects Wang Chengwen and Zhang Guo have been arrested by Jinan City on suspicion of compulsory indecency. The Huaiyin District Bureau of the Public Security Bureau took criminal compulsory measures in accordance with the law, and there is no evidence to prove that the crime of rape occurred. The case is under further investigation.

On September 6, 2021, the People’s Procuratorate of Huaiyin District, Jinan City, Shandong Province reviewed the law and found that the compulsory indecent behavior committed by the criminal suspect Wang Mouwen did not constitute a crime, and the arrest was not approved.

On June 22, 2022, Zhang Guo was sentenced to one year and six months for the crime of forced indecency.
