The Federal Cartel Office said in a statement that it had sent a preliminary legal assessment to Google parent company Alphabet, Google Ireland Ltd and Google Germany Ltd on December 23.
The Federal Cartel Office said that Google currently does not provide users with sufficient options to decide whether and to what extent they consent to the processing of their data.
A Google spokesman said the company would continue to engage constructively with German regulators and try to address their concerns.
The spokesperson added: “We are expected to run our business responsibly, maintaining a user-first product experience while continually updating our services to meet regulator expectations.”
As early as May 2021, the German Federal Cartel Office launched an antitrust investigation into Google. The Federal Cartel Office said at the time that Google’s business model relied heavily on processing user data. Google enjoys a strategic advantage due to access to data relevant to competition.
To use Google’s services, users usually need to set up a Google account first and agree to Google’s relevant data processing terms. Whether these terms are compliant becomes the focus of attention.
Andreas Mundt, head of the Federal Cartel Office, said at the time: “We will take a closer look at Google’s data processing terms. A key question is whether Google gives users enough choice in how their data is used. .”
