According to the document, iQIYI sued that Daofeng Company provided iQIYI membership account rental services in the film and television area of its operating platform, and obtained high profits from it, which caused huge losses to iQIYI Company and constituted unfair competition. .
The defendant, Blade, argued that the rights to the video account should be enjoyed by the user, and the user’s account should belong to personal property. The iQIYI member accounts on the accused platform are all uploaded by users, which is a legitimate punishment of users’ personal property. During the trial, the defendant also argued that iQIYI’s membership system was unreasonable, resulting in users’ demand for renting or leasing video accounts, and video account leasing was a reasonable business model.
After the trial, the court held that Daofeng Company took advantage of iQiyi’s extensive membership and non-member user base, and took advantage of the psychology of some users who intended to obtain improper benefits by renting accounts, so that the accused platform made high profits. The accused behavior of Blade’s Edge violated the principle of good faith and business ethics, and constituted unfair competition.
