Article 1 In order to regulate the information services of short-distance ad hoc networks, safeguard national security and social public interests, and protect the legitimate rights and interests of citizens, legal persons and other organizations, according to the “Network Security Law of the People’s Republic of China”, “Internet Information Service Management Measures”, The “Regulations on the Ecological Governance of Network Information Content” and other laws and regulations formulate these regulations.
Article 2 These Provisions apply to the provision and use of short-range ad hoc network information services within the territory of the People’s Republic of China.
The short-distance ad-hoc network information service referred to in these regulations refers to the use of Bluetooth, Wi-Fi and other information technologies to establish a short-distance network in real time and provide services for publishing and receiving information.
The term “proximity ad hoc network information service provider” as mentioned in these regulations refers to the entity that provides short distance ad hoc network information services through the development or operation of platforms, systems, applications, etc.
The term “proximity ad hoc network information service users” as mentioned in these Provisions refers to the subjects who use the proximity ad hoc network information services to publish or receive information such as text, pictures, audio and video, including publishers and receivers.
Article 3 The provision of short-distance ad hoc network information services shall abide by the Constitution, laws, and administrative regulations, promote socialist core values, adhere to the correct political direction, public opinion guidance, and value orientation, and maintain a clear and clear cyberspace.
Article 4 Encourage short-range ad hoc network information service providers to give priority to adopting safe and reliable short-range ad hoc network technology.
Article 5 Providers of short-range ad hoc network information services shall abide by laws, regulations and relevant state regulations, adopt necessary safety management systems and technical measures, improve risk prevention capabilities, deal with illegal information according to law, prevent and resist the dissemination of bad information, and save relevant record and report to relevant authorities such as Netcom.
Proximity ad hoc network information service users are not allowed to use the service to publish or forward illegal information; they should take measures to prevent and resist the production, copying, and publishing of bad information; Complaints and reports to relevant authorities.
Article 6: In the process of providing services, short-field ad hoc network information service providers shall, in accordance with the provisions of the “Network Security Law of the People’s Republic of China”, require close-field ad hoc network information service users to provide real identity information.
Article 7 In the process of providing services, the short-range ad hoc network information service provider shall provide the matching confirmation function between the publisher and the receiver in a conspicuous and clear manner; each pairing needs to be confirmed and agreed by the publisher and the receiver , shall not be automatically paired by default without the consent of both parties.
Article 8 In the process of providing services, short-distance ad hoc network information service providers shall provide receivers with functions such as closing reception, opting to receive, blacklist automatic rejection, etc., and set the default setting to the closed receiving state; when providing opt-in services , should comprehensively consider the transmission speed, user needs, etc., and set the receiving time reasonably, and automatically switch to the closed receiving state after the receiving time is exceeded.
Article 9: In the process of providing services, short-range ad hoc network information service providers shall not default to provide summary information preview functions such as snapshots and thumbnails without the consent of the recipient.
Article 10 In the process of providing services, short-range ad hoc network information service providers shall provide functions such as usage reminders and risk reminders.
Article 11 Providers of short-range ad hoc network information services shall set up convenient complaint and reporting portals or provide complaint and reporting channels, and promptly accept and handle public complaints and reports about short-range ad hoc network information services.
Article 12 Users of short-range ad hoc network information services shall not commit acts such as intruding into the network, frequently initiating connections, stealing network data, etc., and shall not cause harmful interference to radio services carried out in accordance with the law.
Article 13 Prompt ad hoc network information service providers shall formulate contingency plans for network security incidents, and immediately activate the contingency plans when incidents endangering network security occur, take corresponding disposal measures, and report to relevant competent authorities in a timely manner in accordance with regulations.
Article 14 When a short-range ad hoc network information service provider launches new technologies, new applications, and new functions that have public opinion attributes or social mobilization capabilities, it shall conduct security assessments in accordance with relevant state regulations. If any potential safety hazards are discovered, rectification shall be made in a timely manner until the relevant safety hazards are eliminated.
The mobile application distribution platform shall verify the security assessment.
Article 15 Encourage and guide Internet industry organizations to establish and improve industry guidelines for short-range ad hoc network information services, and guide the healthy and orderly development of the industry.
Article 16 The network information department, the industry and information department, and the public security department have established and improved working mechanisms such as information sharing, consultation and notification, and carry out daily supervision and inspection of short-distance ad hoc network information service providers according to their duties. Ad hoc network information service providers carry out special inspections.
Article 17 Prompt ad hoc network information service providers shall cooperate with cybersecurity and informatization departments, industry and information technology departments, and public security departments in accordance with the law to carry out supervision and inspection work, and provide necessary technical, data, and other support and assistance.
Article 18 Where short-range ad hoc network information service providers and users violate these regulations, the network information department, industry and information technology department, and public security department shall, according to their duties, follow the “Network Security Law of the People’s Republic of China” and “Internet Information Service “Management Measures”, “Regulations on the Ecological Governance of Network Information Content” and other relevant laws and regulations.
Article 19 These Regulations shall come into force on the date of date.
