The U.S. Supreme Court’s landmark ruling on the ability of environmental regulators to limit greenhouse gas emissions from power plants is a blow to the Biden administration’s efforts to fight climate change. In a majority opinion written by Chief Justice John Roberts, the justices ruled that the Environmental Protection Agency (EPA), when it was created in 1970, did not have a special mandate from Congress to reduce carbon emissions. The ruling means that if a Biden administration wants to implement sweeping regulations to rein in emissions, it will rely on pushing Congress to pass legislation. The opinion of the Supreme Court, whose majority justices are conservative, said that “a decision of this magnitude and consequence rests with Congress itself, or an agency acting under the express authority of that representative body.”
