He was arrested after deleting the company’s database and sentenced to 9 months in prison.
According to the news released by the Beijing Court Judgment Network, the client, Jin xx , was dissatisfied with the department leaders because he was taken over by the project during his tenure . IDC also emptied, tampered, and locked the internal tables of the ff.baidu-int.com platform database of the Commercial Quality and Performance Department, resulting in serious consequences.
According to the judgment, the defendant Jin xx , male , 1996 , university culture , was an employee of Beijing Baidu Network Information Technology Co., Ltd. He was released on bail on April 15 .
The People’s Court of Haidian District, Beijing ruled that:
During the period from August to September 2020 , when the defendant Jin xx was in charge of the test and development work of the commercial quality and efficiency department of Beijing Baidu Netcom Technology Co., Ltd., he deleted and modified the data in the Baidu company’s visualization project program database, which caused the system to not be able to produce relevant data normally. In order to restore the data and functions, Baidu paid Beijing Zhonghai Yixin Information Technology Co., Ltd. Judicial Appraisal Office RMB 16,300 .
On March 9 , 2021 , the defendant Jin xx was arrested by the public security organs and brought to justice. Later, with the help of his family, the defendant Jin xx compensated Baidu for RMB 70,000 and obtained understanding.
Judgment in the first instance:
1. Defendant Jin xx committed the crime of sabotaging the computer information system and was sentenced to nine months in prison, suspended for one year.
2. A laptop computer detained in Haidian Branch of Beijing Public Security Bureau and kept as evidence;
Defendant Jin xx refused to accept it and filed an appeal on the grounds that his actions did not cause such a big loss and that 16,300 yuan was not a necessary cost to restore the data. However, in the second instance, the court rejected the appeal and upheld the original judgment.
